Terms of Use

These Terms of Use (“Terms”) govern your access to and use of MyTape.Live (the “Platform”, “Service”). By accessing or using the Platform, you agree to these Terms.

If you do not agree, you must not use the Platform.

1. Definitions

  1. Operator / We / Us: RECLAMA-VEREJAN, Individual enterprise, IDNO 1003600053323.
  2. User / You: any person who accesses or uses the Platform.
  3. Content: text, images, video, audio, links, metadata, comments, messages, and any other material submitted or displayed.
  4. User Content: Content posted, uploaded, or transmitted by Users.
  5. Account: a registered user profile enabling access to features.
  6. Policies: Privacy Policy, Cookie Policy, and other published rules.

2. Eligibility and Account Registration

2.1. You represent that you have legal capacity to enter into these Terms and to use the Platform under applicable law.

2.2. You agree to provide accurate and current information when registering and to keep your Account details updated.

2.3. You are responsible for maintaining confidentiality of login credentials and for all actions taken under your Account.

3. Acceptable Use

You must use the Platform lawfully and responsibly. You agree not to:

3.1. Publish, upload, transmit, or promote Content that is unlawful, threatening, abusive, harassing, defamatory, hateful, discriminatory, or otherwise harmful.

3.2. Violate intellectual property rights or other rights of third parties.

3.3. Engage in fraud, phishing, scams, impersonation, or deception.

3.4. Distribute malware, harmful code, or attempt unauthorized access to systems.

3.5. Interfere with the Platform’s operation, including by excessive automated requests, scraping, or denial-of-service behavior.

3.6. Circumvent access controls, security measures, or moderation decisions.

4. User Content and Responsibility

4.1. You are solely responsible for your User Content and the consequences of posting it.

4.2. The Operator does not endorse User Content and is not responsible for User Content posted by Users.

4.3. You represent and warrant that you have all rights necessary to post your User Content and that it does not violate these Terms or applicable law.

5. Intellectual Property and License

5.1. Your ownership: You retain all ownership rights in your User Content.

5.2. License to the Operator: By posting User Content, you grant the Operator a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, perform, distribute, and make available your User Content solely for the purpose of operating, developing, providing, and improving the Platform, including displaying it to other users as configured by your privacy and platform settings.

5.3. Duration: This license continues while your User Content remains on the Platform and for a reasonable period afterward for backup, caching, legal compliance, and technical processing, unless prohibited by law.

5.4. Operator IP: The Platform software, design, logos, trademarks, and other materials (excluding User Content) are owned by the Operator or licensors and are protected by applicable intellectual property laws.

6. Moderation, Enforcement, and Reporting

6.1. The Operator may (but is not obligated to) review, monitor, and moderate Content to enforce these Terms and protect users and the Platform.

6.2. The Operator may remove, restrict, or limit access to Content or Accounts that violate these Terms or applicable law.

6.3. The Operator may use automated and manual methods to detect violations, spam, or abuse.

6.4. Users may report Content or users via reporting mechanisms. The Operator may take actions at its discretion after review.

7. Suspension and Termination

7.1. The Operator may suspend or terminate your Account, restrict access, or remove Content if:

  1. you violate these Terms;
  2. required by law or valid authority requests;
  3. necessary to protect the Platform, users, or third parties.

7.2. You may stop using the Platform at any time. Where available, you may request account deletion subject to legal retention obligations described in the Privacy Policy.

8. Third-Party Services and Links

The Platform may contain links or integrations with third-party services. The Operator is not responsible for third-party services, content, policies, or practices. Your use of third-party services is governed by their terms.

9. Service Availability and Changes

9.1. The Platform may be updated, modified, or discontinued in whole or in part at any time.

9.2. The Operator does not guarantee uninterrupted availability. Maintenance, technical issues, and external factors may cause downtime.

10. Disclaimers

To the maximum extent permitted by law:

  1. the Platform is provided “as is” and “as available”;
  2. the Operator disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement;
  3. the Operator does not warrant that the Platform will be error-free or secure, though reasonable measures may be implemented.

11. Limitation of Liability

To the maximum extent permitted by law:

  1. the Operator shall not be liable for indirect, incidental, special, consequential, or punitive damages;
  2. the Operator shall not be liable for loss of data, profits, revenue, goodwill, or business interruption;
  3. total liability for any claim relating to the Platform shall be limited to the amount paid by you to the Operator for the Service in the 12 months preceding the event giving rise to liability (or zero if you paid nothing).

Nothing in these Terms limits liability where it cannot be limited by law.

12. Indemnification

You agree to indemnify and hold harmless the Operator from claims, liabilities, damages, and expenses arising out of your User Content, your use of the Platform, or your violation of these Terms or law.

13. Changes to Terms

The Operator may update these Terms from time to time. Updates will be posted on the Platform. Continued use after changes become effective constitutes acceptance.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Moldova. Where applicable, mandatory provisions of EU law may apply for users located in the European Union. Any disputes shall be resolved by competent courts, subject to mandatory consumer protection rules.
